1. About ListOff — Advertising Platform Only

ListOff (ABN to be confirmed) operates a property advertising platform at listoff.com.au.

ListOff is a property advertising platform only. It is not a licensed real estate agent and does not provide real estate agency services as defined under the Property Occupations Act 2014 (Qld) or any equivalent legislation. ListOff does not negotiate property sales, hold deposits, act on behalf of buyers or sellers, or participate in any property transaction.

Vendors and agents place their own advertisements on the platform. All negotiations, contracts, and settlements occur directly between the buyer and the vendor or their appointed agent. ListOff is not a party to any property transaction.

2. Acceptance of Terms

By creating an account, submitting a listing, or using any part of the ListOff platform, you agree to these Terms of Service. If you do not agree, do not use the platform.

At the point of payment for a listing, you will be required to actively confirm your acceptance of these terms via a checkbox. This confirmation is recorded with a timestamp in our systems.

3. Who Can Use ListOff

You must be 18 years or older to create an account or place a listing. By using the platform, you confirm that:

• You are at least 18 years of age.
• You have the legal right and authority to advertise the property you are listing.
• If listing as a licensed real estate agent, you hold a current and valid QLD real estate agent licence.
• All information you provide is accurate and not misleading.

4. Listing Fees and Payment

The fee to publish a property listing on ListOff is $99 AUD (GST inclusive) per listing. This is a one-time flat advertising fee. It is not a commission, transaction fee, or percentage of any sale price. The fee is payable at the time of listing and is processed securely via Stripe.

Payment of the $99 fee entitles the lister to a single listing that remains active for up to 90 days from the date of publication, subject to these Terms.

5. Refund Policy

• Before publication: if your listing is rejected and not published, you will receive a full refund of the $99 fee within 5 business days.
• After publication: once your listing is live on the platform, no refund is available. The advertising service has been delivered.
• Platform failure: if a technical failure on our part prevents your listing from going live within 72 hours of payment, you are entitled to a full refund.
• Fraudulent listings: if a listing is removed due to a breach of these Terms (including fraudulent or misleading content), no refund will be issued.

To request a refund, email support@listoff.com.au with your listing details and reason for the request.

6. Listing Content and Vendor Warranties

By submitting a listing, you warrant and represent that:

• You are the owner of the property or are authorised in writing by the owner to advertise it.
• If you are a licensed agent, you hold a valid agency authority to market this property.
• All information in the listing is accurate, complete, and not misleading.
• Photos submitted are genuine photographs of the listed property taken recently.
• The property is not fraudulently listed — it exists at the stated location and is genuinely available.
• The listing does not breach any existing exclusive agency agreement you or the vendor may have with another agent.

ListOff reserves the right to verify any information in a listing and to remove listings that do not meet our standards, at our sole discretion and without refund where a breach of these Terms has occurred.

7. Minimum Listing Standards

To be approved and published, all listings must include:

• A minimum of 5 genuine photographs of the property.
• A description of at least 150 characters.
• A stated price or "Price on Application."
• An accurate suburb location within Brisbane.

Listings that do not meet these standards will be rejected. A rejection reason will be provided within 24 business hours, and you may resubmit.

8. Prohibited Listings and Conduct

You must not submit a listing or use the platform to:

• Advertise a property you do not own or are not authorised to advertise.
• Post false, misleading, or fraudulent information.
• Collect buyer contact details for any purpose other than genuine enquiry follow-up.
• Solicit holding deposits, transfer of funds, or any financial transaction through or in connection with ListOff.
• Scrape, harvest, or systematically collect data from the platform.
• Interfere with the platform's operation or security.

Breach of this clause will result in immediate account termination and removal of all listings without refund. ListOff may refer fraudulent conduct to the Queensland Police Service or Office of Fair Trading.

9. No Guarantee of Sale or Outcome

ListOff provides an advertising service only. We make no representation or guarantee that listing a property on our platform will result in a sale, enquiry, or any particular outcome. Payment of the listing fee is for the right to advertise on the platform for 90 days — not for any guaranteed result.

10. Buyer Enquiries

When a buyer submits an enquiry on a listing, their contact details (name, email, phone, and message) are sent directly to the vendor or agent who placed the listing. ListOff is not responsible for the response time, conduct, or communications of vendors or agents in response to enquiries.

Buyers must not submit enquiries for any purpose other than genuine interest in the listed property.

11. Intellectual Property

ListOff owns all intellectual property in the platform, including its design, code, trademarks, and brand. By submitting a listing, you grant ListOff a non-exclusive, royalty-free licence to display, reproduce, and distribute your listing content (including photos and description) on the platform and in promotional materials for the purpose of operating the service. You retain ownership of your content.

12. Limitation of Liability

To the maximum extent permitted by Australian law, ListOff's liability to any user for any claim arising out of or in connection with the platform is limited to the amount paid by that user for the relevant listing ($99). ListOff is not liable for any indirect, consequential, special, or incidental loss or damage.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law, including consumer guarantees that cannot be excluded by contract.

13. Account Termination

ListOff may suspend or terminate your account and remove your listings at any time, with written notice and a stated reason, if you breach these Terms. Accounts used for fraudulent or illegal purposes may be terminated immediately without notice. Termination does not entitle you to a refund where a breach of these Terms has occurred.

14. Privacy

Your use of the platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

15. Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia. Any dispute arising from or in connection with these Terms or the platform will be subject to the exclusive jurisdiction of the courts of Queensland. Before initiating legal proceedings, both parties agree to attempt to resolve disputes in good faith through direct communication.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify registered users by email. Continued use of the platform after changes are published constitutes acceptance of the updated Terms.
